The standard of proof in the form of electronic evidence should be more accurate and stringent compared to other documentary evidence, stated a judgement of the Supreme Court.
The judgement was delivered while upholding the election of Manikrao Shivaji Kokate from Maharashtra�s Sinnar constituency in the 2004 parliamentary polls.
The candidate was accused of making inflammatory speeches and a bench of Justice D K Jain and P Sathasivam passed the judgment on an appeal made by Tukaram Dighole, the defeated candidate of the NCP-Cong-RPI combine.
The latter had filed a petition before the election tribunal of the Bombay high court but this was dismissed on the grounds that the video cassette copy containing the alleged inflammatory speeches purportedly obtained from the Election Commission could not be established as genuine.
