SC quashes FIR against couple over FB post against police

The Supreme Court has come to the rescue of a Bengaluru couple being prosecuted for their Facebook post against the local traffic police. The court has quashed the case, saying their post criticising the police could not attract prosecution under charges of intimidation and a form of assault. The court allowed the couple"™s appeal against a Karnataka High Court order.

Manik Taneja and his wife Sakshi were booked under the charges of assault and criminal intimidation by the Bengaluru police in June 2013. The FIR was registered a day after the couple"™s car was involved in an accident with an auto-rickshaw and they were called to a police station for questioning. The police allegedly misbehaved with them, prompting the couple to vent out their anger against the police on Bengaluru traffic police"™s Facebook page.

The bench said:"The appellants might have posted the comment online under the bona fide belief that it was within the permissible limits".
